Please read these terms before using Overassessed MA. By checking the box on the free check, or by otherwise using this website, you agree to these terms. This is a plain-language agreement; a complete legal version may be added before launch.

In short: Overassessed MA is an information-aggregation and form-preparation tool. It is not a law firm, tax advisor, appraisal firm, or government agency, and it does not provide legal, tax, or appraisal advice or guarantee any outcome. You are responsible for reviewing, signing, and filing anything with your city or town.

1. Acceptance of these terms

By accessing or using this website — including running the free assessment check or purchasing the guided abatement packet — you agree to be bound by these Terms & Conditions and by our Privacy summary. If you do not agree, do not use the site.

2. What Overassessed MA is — and is not

Overassessed MA is an automated information-aggregation and form-preparation service. It helps Massachusetts homeowners gather and organize publicly available and user-provided property and assessment information, estimate possible tax impact, and prepare common abatement paperwork such as Massachusetts State Tax Form 128.

Overassessed MA is not a law firm, attorney, certified public accountant, tax advisor, real estate appraiser, broker, or government or municipal agency. It does not provide legal advice, tax advice, appraisal services or opinions of value, representation, or filing services, and using the site does not create an attorney-client, accountant-client, appraiser-client, or any other professional relationship.

3. No professional advice

All content, scores, estimates, comparisons, and prepared documents are provided for general informational purposes only and are not a substitute for advice from a qualified professional. Massachusetts assessment, abatement, and appeal rules are technical and fact-specific. For advice about your particular situation, consult a licensed attorney, tax professional, or appraiser.

4. Information sources and accuracy

The service aggregates information from third-party and public sources (such as statewide and municipal assessment records) and from information you provide. We do not independently verify these sources and do not warrant that any information — including assessed values, comparable properties, tax rates, deadlines, or forms — is accurate, current, or complete. Public records and town requirements change. You must independently verify all facts, figures, forms, deadlines, and filing requirements with your city or town before relying on them.

5. Form preparation; you file it yourself

Where the service prepares a document (for example, a pre-filled Form 128), it does so solely from the information you provide, to help you save time. You are responsible for reviewing the document for accuracy, signing it, and filing it yourself with the appropriate board of assessors or other authority, by the applicable deadline. Overassessed MA does not file documents, submit anything on your behalf, communicate with any town, or track or guarantee any deadline for you.

6. No outcome guarantee

Whether an abatement or appeal is granted, and in what amount, is decided solely by the local board of assessors, the Massachusetts Appellate Tax Board, or another authority — not by Overassessed MA. We make no promise, prediction, or guarantee of any reduction, refund, savings, or other outcome. Any figures shown are illustrative estimates only.

7. Fees

The assessment check is free. The guided abatement packet is offered for a flat one-time fee as stated on the site. Fees are for the preparation tools and information provided, not for any result, and are not contingent on any outcome.

8. Your responsibilities

You agree to provide accurate information, to use the service only for your own lawful property-tax purposes, and to independently confirm all deadlines, forms, and requirements with the relevant authority. The quality and usefulness of any output depends on the accuracy and completeness of the information you provide.

9. Disclaimer of warranties

The service and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any information or document will be accurate or sufficient for your needs.

10. Limitation of liability

To the maximum extent permitted by law, Overassessed MA and its owners, operators, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost savings, lost refunds, missed deadlines, lost opportunities, or loss of data, arising out of or relating to your use of (or inability to use) the service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for any and all claims relating to the service will not exceed the amount you actually paid to Overassessed MA for the service giving rise to the claim in the twelve (12) months before the claim (and, for the free check, this amount is zero). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Overassessed MA and its owners and operators from any claims, losses, or expenses arising out of your use of the service, your submissions, or your filings with any authority.

12. Changes to these terms

We may update these terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules.
